Osun APC Moves to Halt Enforcement of Court Judgment, Files Appeal and Stay of Execution

The Osun State chapter of the All Progressives Congress (APC) has formally initiated appellate proceedings against the judgment delivered by the Federal High Court, Osogbo, in Suit No. FHC/OS/CS/147/2025, while also seeking a stay of execution pending the determination of the appeal.

In a letter addressed to the Inspector General of Police and dated June 17, 2026, counsel to the APC claimants, Chief Kunle Adegoke (SAN), disclosed that the party had filed a Notice of Appeal at the Court of Appeal, Akure Judicial Division, on June 16, 2026, challenging the judgment delivered by Justice Adefunmilola A. Demi-Ajayi on June 15, 2026. The letter further revealed that a Motion for Stay of Execution was filed before the trial court on the same day and remains pending.

According to the letter, “Our clients, being dissatisfied with the Judgment delivered on 15th June, 2026, promptly filed a Notice of Appeal on the 16th day of June, 2026 at the Court of Appeal, Akure Judicial Division.” The senior advocate urged the police and other relevant authorities not to take any step toward enforcing the judgment while the appeal and application for stay of execution are awaiting determination. He argued that executing the judgment at this stage could undermine the appellate process and frustrate the administration of local governments in Osun State. “We respectfully urge you and your good offices to refrain from taking any step towards the execution of the judgment,” the letter stated, citing established appellate court authorities on the need to preserve the subject matter of litigation pending appeal.

The development signals the APC’s determination to challenge the Federal High Court ruling through the appellate process and may further shape the ongoing legal and political contest surrounding local government administration in Osun State.
