The case of defamation instituted by the Osun State House of Assembly Speaker, Hon. Adewale Egbedun, against Oluwasegun Fawale, and one other, was today dismissed by the court for lacking in merit.

Before delivering his judgement today, the chief magistrate, Olusegun Ayilara, was miffed about the decision of the prosecutor to waste the time of the court by electing to withdraw the case prematurely.

He noted that the letter of withdrawal presented was addressed to the commissioner of police and not to the court, therefore was procedurally faulty.

He asked the prosecutor to explain to the court while it should not believe that the case was filed by the claimant to punish the defendants and cause unrest in the state.

Having been under intense pressure, the prosecutor had no other option than to tender apology to the court for the procedural error.

The chief magistrate thereafter rejected the said letter of withdrawal and struck out the case for being frivolous.
